Digital Embroidery & Appliqué Design Policy

Thank you for purchasing digital embroidery and appliqué designs from Designs By Savanna LLC!

We proudly support embroidery enthusiasts, hobbyists, and small businesses. Our goal is to provide creative machine embroidery designs that you can confidently use for personal projects and finished products for your customers.

By purchasing, downloading, or using our digital designs, you agree to the following terms and conditions.

1. Digital Products Only

All embroidery and appliqué designs sold by Designs By Savanna LLC are digital products.

No physical products will be shipped.
Files are intended for computerized embroidery machines.
Buyers must have a compatible embroidery machine to use the designs.
Available file formats, design dimensions, and hoop requirements are listed in individual product descriptions.

It is the customer's responsibility to verify compatibility before purchasing.

2. Personal & Commercial Use License

UNLIMITED COMMERCIAL USE IS INCLUDED WITH YOUR PURCHASE!

We love supporting fellow embroidery businesses!

Every purchased design includes a non-exclusive, non-transferable license allowing the buyer to create and sell an unlimited number of finished physical embroidered products.

You MAY:

Use purchased designs for personal embroidery projects.
Sell unlimited finished embroidered or appliquéd physical products.
Use designs on clothing, bags, accessories, home décor, and other physical items.
Sell finished products through Etsy, Shopify, boutiques, craft fairs, Facebook, and other sales channels.
Create personalized gifts and custom embroidered products.
Use purchased designs for your embroidery business without purchasing an additional commercial license.

There are no production limits, annual fees, or additional commercial licensing fees for finished physical embroidered products.

This license applies only to finished physical products. It does not grant permission to sell or distribute the digital design files.

3. Digital File Restrictions

All digital embroidery and appliqué files remain the property of Designs By Savanna LLC or their respective rights holders.

The following activities are strictly prohibited:

Reselling digital embroidery or appliqué files.
Sharing, trading, gifting, or distributing purchased files.
Uploading files to Facebook groups, websites, file-sharing platforms, or online communities for distribution.
Including our files in digital design bundles or collections.
Claiming our designs or digitizing work as your own.
Copying, tracing, recreating, or modifying designs for the purpose of creating competing digital embroidery files.
Converting files into other embroidery formats for resale or distribution.
Giving purchased files to another individual or embroidery business.
Selling or distributing altered versions of our digital files.

Purchasing a design does not transfer copyright or ownership of the digital design.

One purchase grants the purchasing individual or business a license to use the design under these terms.

4. Modifications & Customization

Buyers may modify purchased embroidery designs for their own embroidery projects and finished physical products.

Permitted modifications include:

Adding names, initials, or monograms.
Combining purchased designs with other embroidery elements.
Adjusting thread colors.
Making reasonable size adjustments.
Customizing appliqué fabric choices.

Modified designs may still be used to create and sell unlimited finished physical embroidered products.

However, modified digital files may not be resold, shared, distributed, or offered as new digital designs.

Please note that modifying, resizing, or altering embroidery files may affect stitch quality. Designs By Savanna LLC cannot guarantee results from modified files.

5. Refunds, Returns & Cancellations

ALL DIGITAL DESIGN SALES ARE FINAL, except where otherwise required by applicable law.

Due to the downloadable nature of digital embroidery files, we generally do not offer refunds, returns, cancellations, or exchanges for:

Accidental purchases.
Purchasing the wrong design.
Purchasing an incorrect size or file format.
Duplicate purchases.
Incompatible embroidery machines.
Lack of embroidery software or equipment.
Changing your mind after purchase.
Not knowing how to use or download embroidery files.

Customers are responsible for reviewing product descriptions and confirming machine compatibility before purchasing.

If you experience an issue with a purchased file, please contact us. We will review reported file problems and work to resolve verified technical defects when possible.

Nothing in this policy limits any rights or remedies that cannot legally be excluded.

6. Stitch-Out Quality & Customer Responsibility

We strive to provide quality machine embroidery and appliqué designs.

However, final embroidery results may vary depending on:

Embroidery machine settings.
Fabric and stabilizer selection.
Thread and needle choices.
Hooping techniques.
Machine tension and maintenance.
Changes or modifications made to the design.

We strongly recommend performing a test stitch-out before embroidering on customer-provided garments, expensive materials, or finished products.

To the extent permitted by applicable law, Designs By Savanna LLC is not responsible for damage to fabric, garments, equipment, or other materials resulting from improper use, incompatible equipment, or modifications to purchased designs.

7. Copyright & Intellectual Property

Original embroidery and appliqué designs created and owned by Designs By Savanna LLC are protected by applicable intellectual property laws to the extent eligible for protection.

All rights not expressly granted under this policy are reserved by Designs By Savanna LLC or their respective rights holders.

Purchase of a design grants permission to use the file according to this policy. It does not transfer ownership, copyright, or intellectual property rights.

Unauthorized reproduction or distribution of protected digital files may result in appropriate enforcement action.

8. Product Photos & Design Previews

Digital listing images, design previews, and product photography created and owned by Designs By Savanna LLC may not be copied, altered, redistributed, or used to advertise competing digital embroidery files without written permission.

Customers are encouraged to photograph their own finished embroidered products when advertising or selling items created with our designs.

9. File Compatibility & Downloads

Customers are responsible for ensuring their embroidery machine supports the file formats and design sizes provided.

Please review each product listing for:

Available embroidery file formats.
Design dimensions.
Recommended hoop sizes.
Any additional instructions specific to the design.

Digital purchases are provided electronically. No physical products will be mailed.

10. License Violations

Failure to comply with the terms of this policy may result in termination of the license for the affected design, subject to applicable law.

Designs By Savanna LLC reserves the right to pursue appropriate remedies for unauthorized copying, distribution, or resale of protected digital files.

Termination of a license does not transfer ownership of the digital design to the buyer.

11. Policy Updates

Designs By Savanna LLC reserves the right to revise this policy when necessary.

Updated terms will be posted on our website and will generally apply to purchases made after the effective date of the revision.

Existing purchases will remain subject to the license terms accepted at the time of purchase unless otherwise agreed or required by law.
